2026 regularisation accepted for processing: what can you do while awaiting approval?
Has your application been accepted for processing but residence not yet approved? Find out when you can work, register as self-employed and prepare your next steps.
Review my acceptance noticeAcceptance for processing of a 2026 regularisation application raises many questions: Can I work already? Must a company hire me? Can I be self-employed? What if approval takes time?
First check which document you received and what permission it recognises. The submission receipt, notice opening the procedure and favourable decision are different documents.
Does acceptance for processing mean my residence has been approved?
No. Acceptance for processing is not a favourable decision. Your application is still under assessment and awaiting a final decision. However, this regularisation provides provisional permission to reside and work linked to the notice opening the procedure.
Three documents to distinguish
- Submission receipt: proves that you submitted the application. Do not confuse it with the opening notice.
- Notice opening the procedure: check that it recognises provisional permission to reside and work.
- Favourable decision: grants the authorisation and allows the relevant documentation steps to continue.
The Ministry explains in its official questions and answers that the submission receipt is not the notice opening the procedure, which is received later.
Can I work after acceptance for processing but before approval?
Yes, if you have received the notice recognising provisional permission and it remains valid. The rules of this regularisation provisionally allow employment and self-employment throughout Spain and in any occupation or sector, under the applicable conditions.
Read the entire document. An application number, assigned NIE or screenshot showing “in progress” does not replace checking that permission.
If a company wants to hire you, prepare the administrative notice and identity documents so its adviser can review your circumstances.
Must I wait for the physical card?
Provisional permission allows access to work before final approval, provided it has been recognised and remains valid. Do not confuse the physical card with the document proving permission to work during this stage.
Prepare a folder with the complete opening notice, passport or identity document, NIE and available information about your Social Security number.
If the company is unsure, ask its adviser to check the notice and legislation before concluding that you must wait for approval.
Can I be self-employed or must a company hire me?
You can work either way: as a company employee or as a self-employed worker. Both options are included in the provisional permission provided by Royal Decree 316/2026.
During this period, waiting for approval does not require you to choose one specific option. Your permission must be valid and the appropriate registrations completed.
If you want to start a business, prepare tax and Social Security obligations and any necessary permits. Opening a hair salon, practising independently or starting a food business may involve different formalities. This permission does not replace the formalities for starting an activity.
Our advice: use this period to work and pay contributions
At TRALIF, we advise clients with recognised, valid provisional permission to use this period to work legally and pay contributions, without necessarily waiting for final approval.
This can be as an employee or self-employed worker: both options are provided for. What matters is that the work and registrations are correctly formalised.
The legislation also provides that, when final authorisation is granted, its effects are backdated to the application submission date. Do not assume you will have a full year from the date you receive approval.
Working while waiting provides income, builds contributions and allows you to prepare the next procedure in advance. When you receive the favourable decision, check its effective and expiry dates.
For a later modification, the requirements of the route appropriate to your situation must be checked. Working now does not by itself guarantee the outcome.
Three months since acceptance for processing: do I lose the right to work?
The official guidance of 22 July 2026 clarifies that merely exceeding the maximum decision period does not end provisional permission already recognised. It remains in force until the express decision ending the procedure is notified.
Do not consider it lost merely because three months have passed without a response. The guidance distinguishes delay from an express refusal, which does end permission under the applicable conditions.
Keep your notice and monitor notifications: establish whether you are still waiting or a decision has already been notified.
What if the company says my document has expired?
Check which document and date the company is reviewing. If the concern is solely that three months have passed, give its adviser the Ministry’s interpretative guidance.
It explains that those already granted permission can continue working until an express refusal is issued. Any other issue or later notification must be reviewed.

Can I apply for the TIE or travel with the acceptance notice?
Fingerprints and foreign national identity card
Official information places the application for the TIE after obtaining a favourable decision. The opening notice does not replace approval for this step.
Keep documents organised and your passport up to date. When approval arrives, read the instructions and deadline for applying for the card.
Can I work in France or another European country?
This permission applies to Spain. Official information states that the permit does not authorise settling or working in another EU country. To work outside Spain, check the destination country’s requirements.
Can I leave Spain and return?
Do not assume that an acceptance notice is a travel document or guarantees your return. Before buying tickets, check your nationality, passport, available residence documents and applicable exit and entry requirements.
Permission to work in Spain does not by itself resolve the requirements for international travel.
What to do while awaiting approval
- Read and keep the complete notice, not just the first page.
- Check that your name, NIE and other details are correct.
- Monitor notifications and keep in contact with your representative.
- Respond to document requests within the stated deadline.
- Keep proof of submitted documents and payments.
- If you plan to work or start a business, prepare the required registrations.
- When approval arrives, check the effective and expiry dates.
Acceptance for processing does not guarantee approval, but may allow you to move forward with work while waiting, if your provisional permission has been recognised and remains valid.
