EU family residence card: requirements and documents

Requirements for the EU family residence card: family relationship, EU citizen’s circumstances, resources, insurance, application and permanent residence.

Assess my case

The EU family residence card, officially the residence card for a family member of a Union citizen, documents the residence rights of certain relatives accompanying or joining an EU, EEA or Swiss citizen. Before applying, check the applicable system based on your relative’s nationality and circumstances.

Who can apply?

Eligible relatives include spouses, registered partners and certain dependent descendants and ascendants. Other relatives or unregistered stable partners may qualify if they prove the circumstances required. Rules and evidence differ by family category.

Spain’s immigration regulations provide a specific authorisation for relatives of Spanish citizens. Cases involving free movement rights and cards already issued require individual assessment. Avoid outdated lists mixing the two systems.

Requirements for the EU citizen

The EU citizen must meet the conditions for staying in Spain beyond three months: for example, employment or self-employment, sufficient resources and health insurance, or studies under the relevant conditions. A marriage certificate alone is insufficient.

If the citizen does not work, check actual resources and health coverage. When dependency is required, prove genuine dependency with coherent documents; unexplained isolated transfers may be insufficient.

Application documents

  • EX-19 form and a complete valid passport.
  • EU citizen’s identity document and registration certificate where required.
  • Certificates of family relationship, registered partnership or stable relationship.
  • Employment, self-employment, resources and insurance documents appropriate to the EU citizen’s circumstances.
  • Evidence of dependency, cohabitation or special circumstances where required.
  • Photograph, fee and other card-issuance documents at the appropriate stage.

Foreign certificates may need translation and an apostille or legalisation, subject to exemptions. Check names, dates and consistency between passports and certificates before applying.

How to apply

Apply within three months of entry into Spain to the competent authority through the channel accepted for your case. Keep the receipt and monitor notifications. A fingerprint appointment does not replace the residence application or an appointment for another police procedure.

The temporary card normally lasts five years, or the EU citizen’s planned stay if shorter. For travel, check your passport, card and requirements for your nationality.

Permanent card and family changes

After five years of continuous legal residence, eligibility for a permanent card can be assessed. It has its own requirements and ten-year validity. Special cases and absence rules must be checked.

Separation, divorce, death or the EU citizen’s departure may affect residence rights. Some cases allow those rights to be retained, but this is not automatic for everyone. Check dates and documents before waiting for expiry.

Frequently asked questions about the EU family residence card

Must I be financially dependent on my partner?

Not every family category requires financial dependency. It depends on the relationship category and the EU citizen’s circumstances.

Is the green certificate my EU family residence card?

The registration certificate belongs to the EU citizen. The family card is for non-EU relatives covered by this system.

Does card expiry mean I have lost my residence rights?

Expiry of the document and loss of residence rights are separate matters. Check the requirements and the correct documentation procedure.
