Long-term residence and EU long-term residence: requirements and recovery
National and EU long-term residence differences: five years, absences, resources, card renewal and recovery after losing authorisation.
Assess my caseThe long-term residence allows indefinite residence and work in Spain under legal conditions. Distinguish national from EU long-term residence. A recovery procedure also exists after loss of either authorisation for certain reasons.
National long-term residence: five years and special cases
The ordinary route requires five years of continuous lawful residence in Spain. Other specific cases exist. Municipal registration is not lawful residence: organise permit decisions and check for gaps without authorisation.
Absences are assessed under continuity rules. Adding years since a first tourist entry is insufficient. Check passports and travel dates before claiming five years.
What EU long-term residence adds
Besides qualifying residence time, sufficient fixed and regular resources and health insurance are required. Some periods and EU Blue Card holders have special rules.
For EU long-term residence, student-stay periods and other specified categories count at 50% if you hold residence status in Spain when applying. Do not apply this rule to every procedure or confuse it with nationality calculations.
Absences: checking continuity
Under the ordinary EU long-term rule, absences of up to six consecutive months preserve continuity if the total does not exceed ten months over five years, subject to conditions. Work-related absences have a special eighteen-month total limit while keeping the six-consecutive-month limit.
Other cases exist, especially mobility and Blue Cards. Identify the category before using those limits and gather evidence of travel reasons where relevant.
Application documents
- Relevant form, complete passport and fee.
- Previous permits and evidence of qualifying lawful time.
- Absence list and documents clarifying dates or reasons.
- For EU long-term residence, resources and healthcare coverage.
- Special-case documents if not using the ordinary route.
Apply to the competent authority depending on whether you are in Spain or abroad. Check conditions and stages separately for each category.
Card renewal is not temporary residence renewal
Long-term authorisation is indefinite, while the TIE expires and must be renewed. An expired card alone does not prove loss of authorisation. Check statutory termination grounds and your circumstances before starting the wrong procedure.
Recovering long-term residence
Where the reason for loss permits recovery, a specific procedure exists, including consular processing where applicable. Prove the prior permit, reason for loss and recovery requirements.
Do not confuse recovery with second-chance arraigo. Assess prolonged travel, another European long-term permit or a non-return commitment before returning or applying.
Frequently asked questions about long-term residence
Can I work in any EU country with Spanish EU long-term residence?
It does not automatically authorise work in every state. It facilitates certain mobility cases subject to destination-country conditions.
Does an expired card mean I lost long-term residence?
Not necessarily. Document validity and authorisation are separate. Check for a statutory termination ground.
Are five years of municipal registration sufficient?
Qualifying lawful residence and continuity are required for the applicable case. Registration does not replace permits.
