Changing residence authorisation: when to switch and required documents
When to modify residence authorisation: switching to work, self-employment or employment, previous permit, requirements, documents and submission.
Assess my caseThe change of residence authorisation allows a switch to another authorisation when its conditions are met. It may suit starting work, moving between self-employment and employment or continuing certain permits. It differs from renewal and is not required for every job change.
First identify your current permit
Check your decision and card: authorisation type, validity and work permission. Some permits already allow both kinds of work; others have specific conditions. Understanding the scope avoids unnecessary changes or unauthorised activity.
Student-stay modifications follow their own route. Retention of status, independent residence for relatives and Law 14/2013 authorisations must also be distinguished.
From temporary residence to residence and work
Article 191 provides for assessing a switch from temporary residence to another residence and work authorisation without a visa, with specific rules depending on residence duration and previous work permission.
A contract or business plan is necessary where required. Employer, activity, qualification and national employment conditions are also assessed where applicable. Approaching permit expiry alone is insufficient.
Switching between employment and self-employment
Before applying, check whether your current authorisation or renewal already allows the new activity. If a switch is required, employment involves assessing contract and employer; self-employment involves the plan, investment and professional requirements.
Self-employment registration or a new contract does not replace immigration authorisation. Coordinate activity commencement with the permit taking effect and Social Security obligations.
Continuing residence after arraigo
Holders of exceptional-circumstances authorisation should assess modification or extension according to their permit and current requirements. Obtaining the first year does not mean automatic renewal.
Gather employment history, activity evidence and current status before expiry. Specific arraigo and other exceptional-permit rules should not be mixed with a generic work-change checklist.
Documents to prepare
- Passport, card and decision for the current authorisation.
- Residence timeline, expiry dates and previous applications.
- Form and fee for the specific modification.
- Contract and employer documents, or self-employment plan and evidence.
- Employment history, income, qualifications and route-specific documents.
- Representation and family documents when other holders are included.
Deadlines and submission
Deadlines and eligible applicants vary by modification. Identify the article and case before setting a date. Any extended validity or provisional effects require checking conditions and the corresponding notice.
Apply to the competent authority, keep the receipt and monitor notifications. After approval, check registration, effect and TIE. TRALIF compares modification with renewal to choose a route fitting your actual situation.
Frequently asked questions about residence modifications
Must I modify my permit when changing employer?
It depends on the permit’s scope and conditions. Not every employer change requires a different authorisation.
Can I switch from non-lucrative residence to work?
Modification may be assessed if the applicable requirements are met. It does not allow work to start before checking when it takes effect.
Do modification and renewal require the same documents?
No. Renewal maintains an authorisation; modification changes route and may require new conditions.
