Immigration refusals and appeal options

What to check after a residence refusal: reasons, notification, reconsideration, hierarchical appeal, court proceedings and appeal effects.

Assess my case

What to do when an application is refused

Review the complete decision. Seeing “unfavourable” in case tracking is insufficient. Obtain the document, check when and how it was notified, and read the reasons and available-appeals section.

The strategy depends on the refusal reasons, documents already in the case and your current circumstances. Appealing, correcting an issue through a new application or considering another authorisation are different decisions. None should follow automatically from a status message.

Documents needed to assess the refusal

  • Complete decision and proof of notification date.
  • Submitted application and registration receipt.
  • Submitted documents and requests received.
  • Registered responses and evidence that may contradict the decision’s reasons.
  • Information on your previous authorisation and immediate consequences of refusal.

Organising these documents helps identify a missing requirement, disputed assessment or procedural problem. A useful appeal addresses the specific reasons with relevant arguments and evidence.

Reconsideration, hierarchical appeal and court proceedings: differences

If the decision exhausts administrative remedies, an optional reconsideration appeal to the same authority or direct administrative court challenge may apply. Otherwise, a hierarchical appeal may be appropriate. They are not interchangeable: check the act’s rules and notification instructions.

Law 39/2015 generally allows one month for reconsideration or hierarchical appeals against an express decision. Law 29/1998 generally allows two months for a court challenge to an express act exhausting administrative remedies. Calculation and administrative silence have special rules; verify your deadline.

If you request reconsideration, you cannot start court proceedings until an express decision or presumed rejection. Court proceedings require assessing the involvement of a lawyer and, where applicable, a court representative, plus costs and procedural effects.

Does appealing allow continued residence or work?

An appeal does not automatically suspend enforcement of the challenged act. Do not assume it preserves a work permit or turns a stay into lawful residence. Effects depend on the permit, decision, applicable law and measures ordered.

A suspension or interim measures may need to be requested and justified. Approval is not guaranteed. This requires particular review if you intend to work, travel or complete procedures requiring valid status.

Mistakes to avoid

Do not wait for a paper letter if an electronic notification already has legal effect. Do not lodge incompatible appeals or copy a template without addressing the actual refusal reasons. Organise evidence and keep the submission receipt.

An appeal does not guarantee approval. Prompt review allows assessment of options and action within the deadline. For court proceedings, consult an authorised professional who reviews the whole case.

Frequently asked questions about immigration refusals

Can every refusal be challenged through reconsideration?

No. It depends on whether the act exhausts administrative remedies and on its rules. Check the decision and appeal instructions.

Do I have one or two months to appeal?

For express acts, the general rule is one month for reconsideration or hierarchical appeals and two months for the relevant court route. The act type and notification determine the exact calculation.

Does filing an appeal guarantee I can work?

No. Appealing neither automatically suspends the decision nor guarantees continued work permission. Check the effects and possible measures.
