Second-chance arraigo: requirements and previous residence

Check when you can apply for second-chance arraigo: previous authorisation, reasons for non-renewal, stay and documents.

Assess my case

The second-chance arraigo provides a possible new residence route for certain people who held an authorisation and did not renew it. It does not automatically apply to every expired card: the previous permit type, dates and reasons for non-renewal matter.

Which previous authorisation is required?

You must have held a residence authorisation granted on grounds other than exceptional circumstances within the two years immediately before applying. Non-renewal must not be due to public order, security or public health, subject to the specified qualifications where there is a judgment rejecting the allegation, dismissal or acquittal.

A student stay is not itself a residence authorisation. This route also differs from recovering long-term residence. Check the decision granting the previous permit; the card’s appearance does not identify every requirement.

General conditions you must also meet

Second-chance arraigo requires being in Spain and, as a general rule, two years of continuous stay. Criminal records, absences, possible entry bans and commitments not to return must be checked, and the fee paid.

You cannot be an international protection applicant when applying or during processing. Time as an asylum applicant is excluded from the stay calculation under the regulation. You must also not hold a stay or residence authorisation or have ongoing procedures included in Article 126.h.

Documents to prepare your application

  • Complete passport, form EX-10 and fee payment.
  • Previous permit decision and a copy of the card.
  • Documents concerning expiry, the renewal application and any refusal or closure decision.
  • Evidence explaining why the permit was not renewed.
  • Evidence of continuous stay and foreign criminal record certificates where required.
  • Relevant court decisions affecting the reason for non-renewal.

Prepare a timeline of grant, validity, application and notification dates. If you have lost the decision, obtain a copy of the file before relying solely on memories or informal messages.

How to apply

First check that your previous permit qualifies and that a renewal or appeal within the deadline is no longer the appropriate route. Then apply to the Immigration Office for your address through an accepted channel and keep the receipt. Answer any request for further documents precisely.

Initial validity is one year and approval includes permission to work under the applicable terms. Submission alone does not automatically authorise work. After approval, apply for the TIE and assess the appropriate modification or extension in time.

Mistakes to avoid

Common mistakes include confusing stay and residence, concealing an earlier refusal, miscalculating the two-year period or missing an appeal deadline assuming arraigo will solve everything. Each route has its own conditions and must be compared before applying.

Frequently asked questions about second-chance arraigo

Do I need an employment contract?

This category does not include the specific employment-contract requirement of employment arraigo. You must prove the previous permit and meet the general conditions.

Does an old arraigo card qualify?

The required previous authorisation must not have been granted on exceptional grounds. Check the decision and consider other possible routes.

Can I apply from outside Spain?

This category requires you to be in Spain. A lost long-term residence permit may call for another procedure.
